The council of the city of Česká Lípa discussed the demolition of Uran

From the minutes of the 7th session of the City Council of Česká Lípa, held on April 27, 2011, at 4:00 PM in the large meeting room of the City Hall, No. 2, T. G. M. Square, 3rd floor.

inquired whether any of the city's committees had addressed the demolition of OD Banca?

no committee has dealt with this; the demolition has been suspended, the city is negotiating with the new owners and the investor, and they have agreed on a public discussion, a survey for the public will go through the city council.

proposed that the appropriate city committees address the demolition of OD BANCO and report to the councilors.

we will not be able to intervene if the owners decide to build something on their property; the building authority will intervene if they want to expand the construction of something, the committees will automatically, as well as the city council, yes.

the city will express itself within the framework of the building proceedings, there is currently nothing to discuss.

asked whether the city can be a participant in the proceedings regarding the demolition of OD BANCA?

yes, it will be a participant in the proceedings; it is only the demolition order, an appeals process.

why are we not a participant in the proceedings?

the relevant provision defines the status of participants in the respective proceedings; once the territorial proceedings commence, the city will be a participant; the building law – the city will be a participant; in the demolition proceedings, the Department of Development, Property, and the City is a participant in the proceedings.

will take it up in the committee of MUDr. Karel Tejnora – the committee for city development and monuments.

will propose to the committee; he did not know how we would decide the situation and would like to ask for advice on who is well-versed in legislation - he requested advice.

Ing. Jaromír Štrumfa
allowed himself to say that Česká Lípa is not only architecturally the Unionka; it is also the Česká Lípa hospital, OD Andy, and OD Banco. Architecture students come to look at these places – what seems ordinary may have value; he learned this from the architecture students he guided around Česká Lípa.

is astonished at where we have gotten to. He is glad that the mayor will bring this to the committees; to express themselves as self-governance.

PhDr. Miroslav Hudec
was surprised by the information that OD Banco would be demolished. He thought there would be no discussion about it; it is new information for him. Unfortunately, he recalled a sad experience from Liberec – OD Ještěd – unfortunately, he had no chance at all. What can be done – issue some statement? The investor will claim it is his property – what can we do about it? He would expect the investor to come to the council and inform the elected representatives of the people about the demolition. If the investor reads this discussion in the council record, it would be decent to come among the councilors and talk about the investment that will change the character of the city.

MUDr. Karel Tejnora
by his discussion contribution was demanding advice on a legal instrument that the committee could use to prevent the demolition; the committee is a group of laypersons. That is all; he thought the city would be interested in it.

Mrs. Nebřenská, head of the department for development, property, and investment, will prepare steps for what the city can do and will pass it on to the committee for city development and monuments and to the committee for the sale and rental of properties.

we should receive materials for the next city council meeting in May; he requested materials.

Materials from the committee should be discussed at the 8th session of the City Council of Česká Lípa, which will be held on Wednesday, May 25, 2011, in the large meeting room of the City Hall.
