Brno - Brno filed a cassation complaint on Monday against the ruling of the Municipal Court in Prague, which dismissed the city's proposal to revoke the heritage conservation zone of Královo Pole. The zone was declared by the Ministry of Culture in 2022. The city hall also filed a proposal in February with the Municipal Court in Prague to revoke the general measure by which the ministry declared the Heritage Zone of Brno concerning the wider center. The Ministry of Culture declared the historically and urbanistically most significant areas of the Brno district of Královo Pole as a heritage zone at the proposal of the National Heritage Institute. The measure came into effect in November 2022. At the beginning of 2023, it also approved the form of the Heritage Zone of Brno, which includes the wider center and parts of Žabovřesky and Brno-north. Last June, the Brno councilors approved the proposal to revoke both heritage zones.
"The Municipal Court in Prague dismissed the proposal to revoke the Královo Pole zone. The city filed a cassation complaint against it this week. In the case of the Heritage Zone of Brno, a proposal to revoke the general measure was submitted in February. In this case, the court has not yet ruled," the spokesperson said.
He added that the current city leadership considers the protection of monuments necessary. "However, the declared zones are larger than necessary. They cover properties and streets that do not need protection and thus disproportionately infringe on the rights of property owners by imposing additional obligations. The city is trying to simplify the permitting process for constructions or renovations, which is made impossible by this. Property owners, whose situation has significantly worsened due to the declaration of the heritage zone, are turning to us," said Poňuchálek. According to him, everyone must now address all repairs with the authorities.
