Brno – The dispute over communications on the sites behind Lužánky in Brno is heading to the regional court. The city of Brno succeeded in April in a dispute with Czechcity at the municipal court regarding the determination of ownership of the communications on the city's properties behind Lužánky, where according to the verdict the communications are part of the land. Czechcity, however, appealed the verdict.


The city wants to build a football stadium in the area, but properties owned by entrepreneur Libor Procházka are obstructing the construction. According to the city, the local communications, including roads, sidewalks, and parking lots, belong to the lands owned by the city. Conversely, Procházka claims that he acquired them from entrepreneur Lubomír Hrstka, who previously built the Bobycentrum hotel and other facilities in the area. According to the city, Hrstka only modified the communications, while Procházka argues that the previous communications were removed and new ones were created.

The judge at the municipal court stated in the April ruling that according to established jurisprudence, purpose-built communications are always part of the land. She also sided with the city's claim that in the past, the majority concerned modifications of the affected areas, not new constructions. According to the verdict, Czechcity was also to cover the costs of the proceedings to the city.

Previously, the city wanted to negotiate a property exchange with Procházka, but the negotiations failed. In the last election period, the ANO movement, led by then-mayor Petr Vokřál (ANO), proposed that the city exchange Procházka's properties behind Lužánky so that it could build the football stadium there. Initially, it was about exchanging for apartment buildings, which their residents and some politicians opposed, and later the exchange of some historical buildings was discussed. The opposition at the time and then-councilor of the Brno-střed district, Markéta Vaňková (ODS), who later became mayor after Vokřál, opposed this. According to the defendants, with the change of political representation, the city is no longer interested in negotiations.

The football stadium behind Lužánky has been deteriorating since the beginning of the millennium, where Zbrojovka previously won its only title. Six years ago, it was revitalized by the farewell to the career of footballer Petr Švancara, which attracted over 30,000 people. Occasionally, sporting or cultural events are held at the stadium; two years ago, a film crew shot a film about the legendary runner Emil Zátopek there.
