MMR Statement: The protection of monuments and public interests will remain intact, panic is unnecessary

Protection of monuments is the subject of the monument care law. The subject of the building law includes, among other things, the regulation of the placement, approval, and removal of buildings. Both legal regulations are part of the legal order of the Czech Republic, and therefore they must correspond with each other. Within the framework of the new building law, monumentally protected objects are specially addressed in accordance with the valid law on state monument care. As part of the integration of agendas, processes related to buildings located in the protective zone of an immovable cultural monument, an immovable national cultural monument, a monument reserve, or a monument zone will be integrated into the Supreme Building Authority. Other processes related to monuments remain under the jurisdiction of the monument care authorities.

The goal of the new building law is to accelerate the building approval process. We want to achieve building permits within one year of submitting a complete application, including appeals and reviews. Monument care authorities are a concerned authority in the building approval process, and therefore, like other non-integrated concerned authorities, they are subject to the uniform regulation to express their opinion on the proposal within 30 days, and the fiction of a binding opinion will also apply to them. The fiction of a binding opinion is already part of the government proposal for the amendment of the currently valid building law, and the new proposal for the building law only adopts this institute.

The standard deadline for submitting comments within the inter-ministerial comment procedure is 20 working days from the date of submission of the bill into the electronic library, in accordance with point VIII of the Legislative Rules of the Government.
