Prague - Minister for Regional Development Klára Dostálová (for ANO) would like to present a new construction law to the government on Monday, August 24. She stated this today in a discussion program on Czech Television, Questions of Václav Moravec. The Legislative Council of the Government recommended the cabinet approve the amended version of the bill after a two-day meeting before the weekend.
"There is nothing fundamental that we couldn't explain; it is only about terminological clarifications. I now have the assurance that we can present it on August 24," Dostálová said today.
According to the government's plan, the law should come into effect in the spring of 2021. The cabinet hopes for significant acceleration and simplification of construction approvals. Its effectiveness is expected to gradually begin by mid-2023. Government legislators returned the proposal to the ministry in June "for further development, especially of certain institutions and procedural and other amendments, which could not be resolved or specifically formulated during the discussion."
After the LRV meeting this week, the ministry stated that there were no significant conceptual changes to the wording of the law, and most adjustments were rather technical matters and legal clarifications to ensure that the law functions as well as possible in practice.
According to the proposed law, after its approval, only one administrative proceeding would be sufficient, and the entire permitting process would be managed by a single building authority. The entire process is to be digitized. Only partially integrated into the so-called single stamp system will be heritage protectors, specifically concerning cultural and national monuments and heritage reserves.
According to representatives of business chambers and unions, the law has diverged from its original form after incorporating comments and will significantly worsen the situation in the construction sector instead of simplifying it. The original proposal of the norm faced numerous criticisms. Among the most common objections was that it favored developers and did not protect public interests. The Association of Local Governments (SMS ČR) stated this week that the law would abolish most building authorities in municipalities and lead to an exodus of experts who have previously handled specialized building agendas there.
Chairman of SMS ČR and MEP Stanislav Polčák (STAN) described the presented law as a hybrid in today's discussion. "What annoys us greatly is how the resolution regarding which authorities will remain in municipalities turned out. Because it is beautifully said - there was an agreement with the Union of Towns and Municipalities that building authorities would remain in municipalities. But they will only remain there in a very limited form," he stated.
According to Dostálová, municipal building authorities are not an emergency service, which means that there is no need for a response time of 20 minutes. "What is necessary is that deadlines are adhered to with clients, or investors, within the building authorities. We had to grasp this in some way. That is why there are measures against inactivity of authorities; therefore, at the municipal levels, only locally competent buildings are handled. Large constructions will be directly under the state building administration," she added.
