Brno - The selection of the contractor for the construction of a part of the Prague metro line D between the Olbrachtova and Nové Dvory stations was conducted properly. This was decided by the Office for the Protection of Competition (ÚOHS), which informed about it in a press release. The selection by the consortium of companies led by Subterra was challenged at ÚOHS by the company Strabag. The decision is not yet final; an appeal can be made to the head of the office, Petr Mlsna. The statement from Strabag is being sought by ČTK.
"The office evaluated the submitted documents and found no reason to intervene in the procedure of the contracting authority. The evaluation of offers concerning the previous experiences of team members, which was questioned by the proposer, was conducted within the framework of legal regulations,” said Markéta Dlouhá, Vice Chair of ÚOHS.
DPP selected the same contractor in 2023, but subsequently cancelled the selection after the non-final decision of ÚOHS. It was then repeated in 2024, but was once again cancelled by ÚOHS, now definitively. Last October, the transport company selected the consortium led by Subterra for the third time.
The project concerns the section from Olbrachtova to Nové Dvory, which will connect to the part between Pankrác and Olbrachtova, being constructed since 2022. However, the tender for the second part is facing issues due to proceedings at the antitrust office initiated by unsuccessful bidders for the contract. The selection of the contractor and thus the construction of the new line have been delayed. The metro from Pankráce to Písnice was originally expected to start operating in 2029, but now it is spoken of as 2031.
In addition to the current proceedings at ÚOHS, the signing of the contract with the tender winner is blocked by a preliminary injunction from the Regional Court in Brno. The court issued it at the request of the PVM consortium, which has challenged the decision of ÚOHS from last September in a lawsuit. The office's decision, and subsequently that of its head, confirmed the legitimacy of excluding PVM from the tender. The court has not yet ruled on PVM's lawsuit.
