Brno - The Clean Tuřany Association filed a lawsuit with the Regional Court in Brno to change the zoning plan in the Černovická terasa industrial zone. They demand the cancellation of the change and a return to the previous state, stated today the director of Clean Tuřany and Brno councilwoman Hana Kašpaříková (Žít Brno). According to her, Černovická terasa was designated for the fields of aviation, space exploration, or electronics, but the change from May 2014 allows for the construction of logistics centers, which the zone was not meant to serve. The change was pushed through by the former leadership of the CSSD and ODS. The American company Amazon wanted to build a giant warehouse on the site, but that fell through.
"The government resolution from October 2000, which proposed the construction of Černovická terasa, indicates that it should be filled with projects from the manufacturing industry, primarily in the fields of aviation, space exploration, transportation, computing, information technology, electronics, telecommunications, and radiocommunications, pharmaceuticals, biotechnology, or medical devices,” Kašpaříková stated.
She also emphasized that the government simultaneously resolved that the industrial zone could not accommodate raw material processing, heavy engineering, chemical manufacturing, textile manufacturing, commerce, storage, and distribution. "These conditions were also reflected in the Brno zoning plan," Kašpaříková noted.
However, in May 2014, the zoning plan was changed, just under a month before the approval of a major update of the Brno zoning plan, which contained many amendments across approximately 10,000 pages. "The goal was to accelerate the process of making a change to the zoning plan so that the intention of locating Amazon's logistics center could get the green light," added Kašpaříková. However, the construction of the Amazon center fell through because the project initially lacked support in the council, and thus the company backed down from the plan. Afterward, the council members approved the construction, but it was too late, and the company was no longer interested.
The Regional Court in Brno already ruled in favor of 15 plaintiffs last January, who sought the annulment of the update of the Brno zoning plan that was approved by the previous council in June 2014. According to the plaintiffs, the document allowed for the legalization of illegal constructions, construction in green areas, increased floor area ratios, and favored developers. The court annulled the update due to the unreviewability of some decisions. Brno is therefore following a zoning plan that is over 20 years old.
