Pardubice - Pardubice entrepreneur Miloš Holeček continues to try to overturn the decision of the building authority regarding the removal of the villa he built without a building permit. After the city hall rejected his appeal, he turned to the court with a lawsuit, said Lenka Tobolková, head of the building authority of the first city district, to ČTK. The legal battle may continue for months or even years.
      "Mr. Holeček has filed an administrative lawsuit, and we have already forwarded the case to the Regional Court in Hradec Králové," Tobolková stated. If the entrepreneur does not succeed again, he may still file a cassation complaint with the Supreme Administrative Court. The cassation complaint does not have a suspensive effect; Holeček would have to request it through another proposal.
      The entrepreneur began constructing the villa Na Ležánkách in 2008 without a building permit. He could not obtain it as the land was not classified as a building plot. Therefore, the building authority decided on the removal of the structure.
      Holeček admits that a larger portion of his land is designated as recreational greenery in the zoning plan. The entrepreneur claims that in the past, he cooperated with the city regarding the exchange and sale of certain plots and allegedly had a promise for a change in the zoning plan for the Na Ležánkách area. However, the city recently rejected his proposal for the third time.
      For the illegal construction, Holeček also received a fine of 200,000 crowns. The decision was confirmed last year by the Supreme Administrative Court.
      The entrepreneur had the land with the villa fenced and argues that the area cannot serve as recreational greenery today. "This use completely devalues Mr. Holeček's land, without its use as recreational greenery being justified in light of the condition of this area and aiming to promote only public interests," said Milan Podolec, Holeček's authorized representative, to ČTK. According to Tobolková, the fencing was approved to a certain extent even before the previous zoning plan came into effect when there were no regulations in place. "The appellate body later rejected our decision to remove the fence at least in the areas of recreational greenery," Tobolková added.
