Brno - The Green Party will file a lawsuit with the Regional Court in Brno over the change to the Brno land use plan from 2011, which, according to them, allowed the family of Deputy Mayor Ladislav Macek (ČSSD) to legalize a clandestinely built playground with a pool near their family cottage. Martin Ander, chairman of the Brno Greens, told journalists today. According to him, the change was made secretly and without discussion in the city council by city hall officials who are directly subordinate to Deputy Mayor Macek. "I am not in a position to comment on the actions of the officials. There are usual control mechanisms that verify the correctness of official actions," Macek told CTK. According to him, the whole case is purposeful. "If the update of the Brno land use plan had not been discussed in the city council, the Greens would not have concerned themselves with this matter at all," Macek said. He added that the Greens could have filed a lawsuit as early as 2011. "Council member Ander was aware of this change," Macek added. However, Ander denies this. "We had a suspicion that something like this was being considered, but we did not know that something like this had been approved. It did not pass through the council, which is what surprises us," Ander stated. The lawsuit that the party will file within a week will aim at the procedure of the city hall. "The playground with the pool was partially built on family land and partially on city land that the family rents from the City Forests of Brno. However, neither the family land nor the rented land was designated for construction," Ander stated. However, according to Ander, there are other city lands nearby where the possibility of construction for recreation and public sport existed. "After the change of the land use plan in August 2011, the usage was exchanged. The lands of Deputy Mayor Macek's family became building lands along with the rented lands, while the city land remained a non-building green area," Ander explained. According to him, the intervention was illegal and the officials should not have proceeded without discussion in the city council. "Officials did not have the right to carry out these actions. Without the consent of the elected representatives of the citizens, they deprived the city of an area that could be utilized for the future construction of a public sports facility. Instead, the family of the deputy mayor, under whom the officials directly fall, gained the right to build. It is an incredible conflict of interest," Ander pointed out, adding that precisely for this reason it is not possible to believe that changes to the land use plan are prepared objectively and impartially. According to Ander, the whole case will have further consequences due to the planned exchange of the land that the city rents to the Macek family for another piece of land owned by the Macek family. "The rented city land contains part of the playground and pool, and that is why the family wants to acquire it. They offer a plot of forest land in exchange, which is, however, disadvantageous for the city given the price," Ander added. Macek commented that there will be dozens of various exchanges carried out. "If my relatives were not involved in the case and if it were not at the time of the approval of the land use plan, no one would be interested in it, and it would be without problems. I deny any conflict of interest in the entire matter and will not let myself be threatened or blackmailed," Macek emphasized.
