Brno - The reconstruction of the Brno railway junction lost its zoning decision in mid-December last year due to errors made by officials from the building office and the city council. According to the regional court, which annulled the decision, the officials of the building office violated the procedural rights of the participants in the proceedings by inadequately justifying why they refused to address their objections to the construction. The authorities must announce a new zoning procedure in which they will have to reconsider the objections, said Miroslav Patrik from the organization Children of the Earth today to ČTK.
    The extent to which the court's decision threatens the planned start of construction costing 20 billion crowns is not yet clear. "The judgment is over 40 pages long, and its study will take at least until Friday. If it is only a matter of properly addressing the objections, obtaining a zoning decision could take several months, and if the entire EIA has to be redone, it would take much longer," said Martin Ander, the deputy mayor of Brno, today to ČTK.
    The court's judgment became legally effective on Wednesday when it was received by the participants in the proceedings. "According to the court, there was a serious violation of the procedural rights of the participants in the zoning procedure because officials either superficially dealt with their objections or even simply copied the negative statements from the investor or designer, which is completely unacceptable in a rule of law," said Patrik, who believes that senior officials should be removed from their positions.
    According to Patrik, a new zoning decision could be issued no earlier than the end of this year, but more likely in the spring of 2010, when, according to the plan, the construction procedure should begin. "In my opinion, the annulment of the zoning decision is an opportunity to adjust the entire project of the railway junction reconstruction and allow for at least partial operations at the existing station in the center," added Ander.
    More than ever, the project of a city rapid transit system is thus in play, which could connect previously irreconcilable projects - the displacement of the station and its reconstruction in the center. The new train station will be built about a kilometer south of the current one, but it will be connected to the existing one precisely by the rapid transit line. Regional train connections should still stop in the city center, five minutes' walk from the central Freedom Square. The study for the rapid transit system, which the city ordered last year, should be completed by June of this year.
    There is no appeal against the judgment of the Regional Court; only an extraordinary remedy, a so-called cassation complaint, can be used. However, it does not have a suspensive effect. According to Ander, it is not yet possible to predict whether the city council will file a cassation complaint; the decision will be made after the case is studied by lawyers with the city leadership.
    The reconstruction of the Brno railway junction is the most extensive construction project in the history of the South Moravian Region. It involves the construction of a new main station, which is to be built about 800 meters south of the current station in the historic center of the city, the construction of a staging station, and the overall modernization of the railway passage through Brno.
    The reconstruction of the Brno railway, which is related to the displacement of the station and the construction of the rapid transit line, is one of the most discussed construction projects in Brno in the last decade.
