Prague - Prague will have to notify the European Commission about the planned amendments to its construction regulations. This was stated by Ondřej Votruba, Deputy Minister for Local Development, at today's Czech Construction Forum. The ministry is collaborating with the city hall on the preparation of the amendments. Up until now, the city hall had claimed that the technical amendment would not require notification. However, the deputy mayor of Prague stated today that the letter from the European Commission indicates that Prague will have to carry out the notification. The original regulations were revoked by the Ministry of Local Development due to objections and a heated public debate in January. The Prague city hall is currently preparing two amendments - a technical one and a substantive one. "The question of notification depends on what exactly will be included in those amendments. If they again include technical requirements for products or parts of buildings, which seems likely, then the notification will be necessary," warned Votruba, who is responsible for public investment at the ministry. Prague is also a region, and according to Votruba, regions must automatically have such documents notified. He added that the ministry is working intensively with Prague on the preparations. "When the Prague construction regulations were being prepared, communication did not work well. Now it does. I hope that because of this, the amendments will be better prepared and we as a ministry will not have to suspend their validity again," he said. Deputy Mayor Matěj Stropnický (SZ) acknowledged today for the first time that the Prague city hall will have to send both the planned technical amendment and the more extensive substantive changes to the implementing regulation to the European Commission for assessment. "I think the more likely scenario is that we will have to carry out the notification," Stropnický told ČTK. The European Commission has already responded to the city hall, stating that if the Prague construction regulations are considered a technical regulation, then notification is necessary. "However, the EC did not express its view on whether the Prague construction regulations are or are not a technical regulation," Stropnický noted. He also emphasized that they are now working on the preparation of the regulations in collaboration with the Ministry of Local Development, which has sent its representatives to the preparatory consultation group. "The Ministry has been accommodating and has provided, I believe, the best experts, namely the head of the construction code department and the head of urban planning. This will be a guarantee that the Prague construction regulations will indeed be prepared in accordance with the law," hopes Deputy Stropnický. The Prague construction regulations are an implementing regulation to the building law. Last year, the billboard lobby launched a strong media campaign in protest against the regulations, as they disagree with the advertising regulation imposed by the regulations. It also targeted Prague's long-standing contract with JCDecaux, which allegedly disadvantages competitors in advertising. Architects and developers, on the other hand, welcomed the change. The Ministry of Local Development revoked the regulations in January due to several objections, which subsequently led to demonstrations by part of the professional community. Finally, after several delays, the council approved two amendments to the regulations in February. The temporary technical amendment is expected to come into effect around May. The police have taken an interest in the regulations, and based on a prompt, the antimonopoly office is now investigating them as well.
