Brno - The Office for the Protection of Competition (ÚOHS) has not yet completed its investigation into Prague's building regulations, in which it identified competition issues related to the advertising market. The capital city made changes to the regulation this week. ÚOHS will study the changes and will only decide later whether to conclude its investigation or not, said office spokesman Martin Švanda today. "Our office did not receive the amended Prague building regulations before their approval, and representatives of the City of Prague did not consult with the office, even though ÚOHS offered consultation," Švanda stated. According to him, ÚOHS sees competition issues in the advertising market not in the existing building regulations, but primarily in their combination with a long-term contract concluded with JC Decaux. "There were several possible options for removing this unfavorable situation, and it was solely up to the City of Prague how it would choose to address it," Švanda added. Representatives of the Magistrate claimed that with the change in advertising regulation brought about by the new building regulations, Prague met the objections of ÚOHS. They did not want to give a pretext for the office to cancel the prepared amendment or for the Ministry of Regional Development to completely abolish the possibility for the metropolis to have its own building regulations, said Deputy Mayor Matěj Stropnický (Trojkoalice/SZ) on Tuesday. "In a situation where the Ministry of Regional Development is preparing an amendment to the building law, which so far allows Prague to have its own building regulations different from the nationwide ones, the city cannot afford to let itself be challenged or even canceled by the antimonopoly office due to provisions about advertising," said the deputy. "Losing the option to have an independent regulation would be fatal for the capital city, and there are leaks of information that the ministry could use the unresolved objections of ÚOHS as a pretext for this step," Stropnický stated. The antimonopoly office claims that the original regulations only regulated one format of advertising and thus only one business sector. Therefore, the amendment relates not only to the regulation of billboards, but also to smaller formats of advertising or posters on buildings. Building regulations are the implementing regulations for the building law. The original wording was recently canceled by the Ministry of Regional Development due to objections. This happened after a tumultuous media spat triggered by the billboard lobby precisely because of the regulation of advertising.
